These Terms of Service ("Terms") govern your access to and use of nozloo.com (the "Site") and any purchase made through the Site. Please read these Terms carefully before placing an order. By using the Site or placing an order, you agree to be bound by these Terms.

1. About Us

The Site is operated by NOZLOO KITCHEN & BATH LLC ("NOZLOO," "we," "us," "our"), a limited liability company registered in the State of California, United States. References to "you" or "your" mean the individual or entity using the Site or placing an order.

NOZLOO designs and sells fireclay farmhouse kitchen sinks directly to consumers through nozloo.com.

2. Eligibility

By using the Site or placing an order, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract under the laws of the United States and your state of residence.

NOZLOO products are sold for residential use within the contiguous United States only. We do not currently ship to Alaska, Hawaii, U.S. territories, P.O. boxes, military addresses (APO/FPO), or international destinations.

3. Products and Pricing

We make every effort to display our products accurately, including dimensions, weight, materials, color, and finish. However, actual product appearance may vary slightly due to:

  • Monitor and device color settings
  • The handcrafted nature of fireclay (minor surface variations, slight glaze pooling, and small kiln marks are characteristics of authentic fireclay, not defects)
  • Photography lighting

All prices are listed in U.S. dollars and are subject to change without notice. Prices displayed at the time you place an order are the prices that apply to that order.

We reserve the right to:

  • Correct pricing or product description errors at any time, including after an order is submitted
  • Limit order quantities
  • Refuse or cancel any order at our sole discretion, including orders that appear to be placed by resellers or for non-residential use
  • Discontinue any product without notice

If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.

4. Orders and Payment

By submitting an order, you make an offer to purchase the products listed in your order at the prices and terms displayed at checkout. Your order is not accepted until we send an order confirmation email and charge your payment method.

We accept payment through the providers listed at checkout (such as major credit cards, Shop Pay, PayPal, and other approved methods). By providing payment information, you represent that you are authorized to use the payment method.

We reserve the right to verify your identity and payment information before processing an order. Orders may be delayed or cancelled if verification cannot be completed.

5. Shipping and Delivery

Shipping terms, transit times, and delivery procedures are set out in our Shipping Policy, which is incorporated into these Terms by reference.

Fireclay sinks are heavy items shipped via freight carrier. You are responsible for:

  • Providing an accurate, accessible delivery address
  • Inspecting the pallet and outer packaging at the time of delivery
  • Noting any visible damage on the carrier's delivery receipt before signing
  • Being available (or designating someone over 18) to receive the delivery

Risk of loss passes to you upon delivery to the address provided in your order.

6. Returns and Refunds

Returns, refunds, and arrival claims are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. Key points:

  • Shipping damage, a visible manufacturing defect, missing included parts, or an item different from the NOZLOO order must be reported within 48 hours of delivery and before installation.
  • Eligible non-defective returns may be requested within 30 days of delivery and require prior authorization.
  • For an approved customer-choice return, NOZLOO provides a prepaid label, discloses its actual cost before confirmation, and deducts that cost from the refund. No restocking fee applies.
  • For an approved arrival issue or NOZLOO fulfillment error, NOZLOO covers the return shipping cost.
  • The customer repacks the sink, attaches the provided label, and hands the package to the named carrier. NOZLOO does not arrange carrier pickup.
  • This return-shipping fee policy applies to orders placed on or after July 23, 2026. Earlier orders retain the return-shipping terms shown when purchased.

7. Warranty

The fireclay sink body is covered by a Limited Lifetime Warranty against manufacturing defects under normal residential use. The full terms of the warranty are set out in our Warranty Policy, which is incorporated into these Terms by reference.

The warranty does not cover:

  • Accessories included with the sink (cutting board, drying rack, bottom grid, drain assembly) — these have no warranty coverage
  • Damage caused by improper installation, abrasive cleaners, impact, or misuse
  • Commercial, industrial, or non-residential use
  • Installation costs, removal costs, or any consequential damages
  • Cosmetic variations inherent to handcrafted fireclay

The Limited Lifetime Warranty is the sole and exclusive warranty provided by NOZLOO. All other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, are disclaimed to the maximum extent permitted by applicable law.

8. Installation

NOZLOO products are designed for installation by a qualified professional. You are responsible for ensuring that:

  • The sink fits your cabinet, countertop, and plumbing configuration before installation
  • Installation complies with all applicable building codes and manufacturer instructions
  • The product is inspected for damage before installation begins

Once a sink has been installed, it is no longer eligible for return. NOZLOO is not responsible for installation costs, countertop modifications, plumbing modifications, or any costs associated with removing or replacing an installed sink.

9. Intellectual Property

All content on the Site — including text, images, photography, logos, product designs, graphics, and software — is owned by or licensed to NOZLOO and is protected by U.S. and international intellectual property laws.

You may not:

  • Copy, reproduce, distribute, or create derivative works from Site content without our written permission
  • Use the NOZLOO name, logo, or product imagery for commercial purposes without authorization
  • Scrape, data-mine, or use automated tools to access the Site

You may share product links and images for personal, non-commercial purposes (such as social media posts about your purchase) without prior permission, provided you do not modify the content.

10. User Conduct

When using the Site, you agree not to:

  • Submit false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Use the Site for any unlawful purpose or in violation of these Terms
  • Interfere with the operation, security, or integrity of the Site
  • Attempt to gain unauthorized access to any part of the Site or our systems
  • Submit reviews or content that is defamatory, obscene, infringing, or otherwise objectionable

We reserve the right to remove any user-submitted content and to terminate access to the Site for any user who violates these Terms.

11. Reviews and User Submissions

If you submit a review, photo, comment, or other content to the Site or tag NOZLOO on social media, you grant NOZLOO a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content for marketing and promotional purposes, with appropriate credit where applicable.

You represent that any content you submit:

  • Is your original work or that you have the rights to share it
  • Does not infringe on any third party's rights
  • Is accurate and reflects your honest opinion (for reviews)

12. Disclaimers

The Site and all products are provided "as is" and "as available" without warranties of any kind, except for the Limited Lifetime Warranty expressly provided in Section 7.

To the maximum extent permitted by applicable law, NOZLOO disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability
  • Implied warranties of fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties arising from course of dealing or usage of trade

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, NOZLOO and its officers, directors, employees, and affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damage to property other than the product itself
  • Costs of installation, removal, or replacement of any product
  • Damages arising from misuse, improper installation, or modification of the product

Our total aggregate liability for any claim arising out of or related to a product or your use of the Site shall not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless NOZLOO and its officers, directors, employees, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of:

  • Your breach of these Terms
  • Your misuse of the Site or any product
  • Your violation of any law or third-party right
  • Any content you submit to the Site

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product shall be resolved as follows:

  1. Informal resolution. Before filing any formal claim, you agree to contact us at info@nozloo.com and attempt to resolve the dispute informally for at least 30 days.
  2. Venue. If informal resolution fails, any legal action must be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts.
  3. Class action waiver. You agree that any dispute will be resolved on an individual basis and waive any right to participate in a class action, class arbitration, or other representative proceeding.

16. Modifications

We reserve the right to modify these Terms at any time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.

For material changes, we will make reasonable efforts to notify you (for example, by email if you have an account, or by a notice on the Site).

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Warranty Policy, and Shipping Policy, constitute the entire agreement between you and NOZLOO regarding your use of the Site and any purchase, and supersede any prior agreements or understandings.
